Former FBI Director James Comey was indicted by President Donald Trump’s lawyer Lindsey Halligan, who was sworn in on Sept. 22 as U.S. attorney for the Eastern District of Virginia after her predecessor, Erik Siebert, resigned in response to pressure from the Trump to charge Comey, notes Yahoo News.
Halligan, a former beauty queen contestant in Colorado who has never tried a criminal case, charged Comey with one count of making false statements and one count of obstruction of justice. Comey’s lawyer will be highly-respected former prosecutor Patrick Fitzgerald, notes Bloomberg Law:
“He’s gone to one of the best lawyers in the country, who is also his friend, to guide him in this situation,” said Joshua Naftalis, a former Manhattan federal prosecutor. Naftalis, who did not work Comey or Fitzpatrick, is now a partner at litigation boutique at Pallas Partners.
Fitzgerald led prosecutions against Illinois governors Rod Blagojevich and George Ryan. He also steered an investigation that resulted in criminal charges against Scooter Libby, chief of staff to ex-Vice President.
Trump publicly demanded U.S. Attorney Pam Bondi charged Comey in an angry rant on his social media site, Truth Social, on Sept. 20: “We can’t delay any longer. They impeached me twice, and indicted me (5 times!), OVER NOTHING. JUSTICE MUST BE SERVED, NOW!!!”

The New York Times reported on Sept. 24 that Halligan was “racing to present a case” against Comey “even though career prosecutors determined there was insufficient evidence to indict” him.
Halligan — a former insurance lawyer — had to rush her indictments of accusing Comey of lying to Congress five years ago because the statute of limitations was about run out.
